§1 Scope

  1. These general terms and conditions (hereinafter "Terms") apply to all contracts concluded between Lastminuto Holding, represented by its management, (hereinafter "Lastminuto", "we" or "us") and the customer (hereinafter "you" or "customer") via the internet platform www.lastminuto.com.
  2. Lastminuto operates an online platform for arranging travel services (package trips, hotels, flights) from various tour operators and service providers. In addition, Lastminuto gives every customer an exclusive health bonus in the form of a free vitamin package when they book.
  3. Differing, conflicting or supplementary terms and conditions of the customer do not become part of the contract unless their validity is expressly agreed to in writing.

§2 Conclusion of contract

  1. The presentation of travel offers on our platform does not constitute a legally binding offer, but an invitation to submit an offer (invitatio ad offerendum).
  2. By clicking the "Book with obligation to pay" button, you submit a binding order (offer). We confirm receipt of your booking by email without delay.
  3. The contract is concluded when we accept your booking by sending a separate booking confirmation by email. This booking confirmation contains all key travel details as well as information about your health bonus (vitamin package).
  4. For package trips, the travel contract is concluded directly between you and the respective tour operator. Lastminuto acts as an intermediary in this case.

§3 Services

  1. Lastminuto provides a platform on which travel services from various providers can be compared and booked.
  2. We owe only the proper arrangement of the travel service, not the travel service itself.
  3. Carrying out the trip is the responsibility of the respective tour operator or service provider with whom you conclude the travel contract.

§4 Prices and payment terms

  1. All prices shown are final prices including statutory VAT and all fees, unless stated otherwise.
  2. Payment can be made by credit card (Visa, Mastercard, American Express), PayPal, instant bank transfer, SEPA direct debit or by invoice (subject to a credit check).
  3. The travel price is due immediately upon conclusion of the contract, unless a different payment deadline has been agreed.
  4. No additional fees apply for Lastminuto's intermediary service. Our service, including the health bonus, is free of charge for you.

§5 Cancellation and rebooking

  1. The terms of the respective tour operator or service provider apply to cancellations and rebookings.
  2. Cancellations must be made in writing (by email to info@lastminuto.com). We forward your cancellation to the tour operator without delay.
  3. The amount of any cancellation fee is governed by the terms and conditions of the respective tour operator and the time of cancellation.
  4. We recommend taking out trip cancellation insurance, which you can optionally add during the booking process.
  5. With flex rates, free cancellation is possible up to 24 hours before departure, provided the provider offers it.

§6 Liability

  1. As an intermediary, Lastminuto is not liable for the fulfillment of the travel services arranged. Liability for the proper execution of the trip lies with the respective tour operator.
  2. We are liable without limitation for damages arising from injury to life, body or health that are based on an intentional or negligent breach of duty.
  3. For other damages we are liable only in cases of intent and gross negligence, unless the breach concerns essential contractual obligations.
  4. Liability for indirect and consequential damages is excluded to the extent permitted by law.
  5. The manufacturer is liable for the quality and tolerability of the vitamin package in accordance with statutory provisions. Lastminuto accepts no liability for intolerances or allergic reactions.

§7 Data protection

  1. Personal data is processed in accordance with our privacy policy, which can be viewed on our privacy policy page.
  2. We use your data exclusively to process the booking and to fulfill legal obligations.
  3. Your data is passed on to the respective tour operator only to the extent necessary to carry out the trip.
  4. With your consent, we use your email address to send you our newsletter with exclusive travel offers and health tips. You can withdraw this consent at any time.

§8 Final provisions

  1. The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods (CISG).
  2. The place of jurisdiction for all disputes arising from this contractual relationship is Berlin, to the extent permitted by law.
  3. The European Commission provides a platform for online dispute resolution (ODR):https://ec.europa.eu/consumers/odr
  4. We are neither obliged nor willing to take part in dispute resolution proceedings before a consumer arbitration board.
  5. Should individual provisions of these Terms be or become invalid, the validity of the remaining provisions remains unaffected.
